Permits

The City of Bayswater may issue permits for a variety of activities as outlined in the Activities in Thoroughfares and Public Places and Trading Local Law 2020.

Permits may be issued for:

  • Stallholders and traders 
  • Temporary advertising signs on verges
  • Filming
  • Performing (including busking)
  • Play equipment on verge
  • Materials on verge ( sea containers)
Stallholder and traders permit

A person shall not trade, including from a stall, in a public place within the City of Bayswater, unless they are the holder of a valid permit. Trading includes selling and/or hiring goods and/or services.  Exemptions apply so please refer to the Local Law for further information.

Temporary advertising signage permit

A person shall not place an advertising sign on a verge or in a public place without a valid permit. Conditions and exemptions apply so please refer to the Local Law for further information.

Filming permit

A permit is required for filming in a public place within the City of Bayswater. Conditions and exemptions apply so please refer to the Local Law for further information.

Performing permit

Buskers and street entertainers who perform in a public place within the City of Bayswater must apply for a permit. Conditions and exemptions apply so please refer to the Local Law for further information.

Play equipment on verge permit

The City of Bayswater has developed guidelines to assist residents in placing play equipment of verges and attaching swings to trees. Some play equipment is permitted however others will require a permit. Please refer to the Play Equipment on Verge Guidelines for more information, exemptions and conditions.

If your equipment does not comply with the guidelines and you would like to apply for a permit please complete and return the Play equipment on verge permit application  in person or by email.

 

Deposit materials on verge (sea containers)

If you are wanting to place a sea container on a verge you will require a permit.

Alfresco dining permit

Alfresco dining permits during the COVID-19 crisis

The City has waived the requirement for an alfresco permit to help local businesses get back up and running as COVID-19 restrictions begin to ease.

Obtaining an alfresco dining permit outside the COVID-19 crisis

Alfresco dining areas are exempt from planning approval however a permit for Alfresco Dining under Part 10 - 'Outdoor eating facilities on public places' of the City's Activities on Thoroughfares and Trading in Thoroughfares and Public Places Local Law is required. There is no fee applicable to the issue of this permit.

To obtain a permit, an Alfresco Dining Permit Application needs to submit with a scaled plan detailing the proposed outdoor dining area and meet the following requirements:

  • The alfresco dining furniture is located in front of the associated business; 
  • The alfresco dining area ensures a minimum clear footpath width of 2.0m in all cases. Pedestrians are to be able to make normal use of the footpath;
  • A copy of their Public Indemnity Insurance.
  • In accepting the permit, the permit will agree:
    • to indemnify and hold indemnified the Crown and the City of Bayswater against any claims for any loss, damage or injury however arising from the operation of the al fresco area; and
    • not to claim from the Crown or the City of Bayswater or any person acting on their behalf, for any loss, damage or injury however arising from any public work on the thoroughfare or public place.

.  There is no fee applicable to the issue of this permit.
